Rights & Remedies

We are dedicated to delivering a quality product to all our customers. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. All of our products are warranted for a minimum of one year (12 months) from date of purchase against defects in material and workmanship.

If we determine that the product has a manufacturing fault, we will repair or replace it free of charge to you. The decision to repair or replace is solely at the discretion of kkdu plum pty ltd. We may decide to send you self-repair instructions or a suitable self-repair kit.

Due to some parts being discontinued and/or unavailable, replacement parts and product may be subject to minor variations when compared to the faulty part.

Proof of purchase?

It is our requirement that all warranty claims are accompanied by a proof of purchase (sales receipt) to allow verification of the date of purchase. The warranty applies only to the original owner of the product and is not transferable. If your item is faulty upon receipt or is not as described, we will gladly exchange the item or refund your purchase.

Where proof of purchase is not provided, kkdu plum pty ltd reserves the right to charge a service fee and/or charge for parts replaced/repaired. A return freight charge may apply. Please retain your Proof of Purchase.

What is not covered under warranty?

Our manufacturing warranty does not cover claims resulting from misuse, abnormal use, overloading, general wear and tear, the carrying of people or animals, not following instructions, transportation damage (including airline or freight damage), poorly maintained product, dropped goods, negligence, second hand product, modified product, colour fading, over inflation, mould, or damage to handle wrap in use. Our warranty also does not cover tyre punctures or corrosion to frames or fasteners as a result of atmospheric or environmental conditions.

The small print.

Liability for subsequent defects

We will repair or replace Goods which fail to comply with the provisions of the Competition and Consumer Act 2010or which show a defect. If you claim that the item is defective, the following conditions apply:
1. the defect must be reported to us within 10 days of becoming apparent;
2. the defect results only from faulty design or manufacture;
3. you have returned the defective Goods or parts to us if we have so requested.
4. If we agree that we are liable, we will refund the cost of return carriage and will repair or replace the Goods free of charge.
5. If we repair or replace the Goods, you have no additional claim against us either under this agreement or by statute or common law, in respect of the defect.

Goods returned

These provisions apply in the event that you return any Goods to us for any reason:
1. We do not accept returns unless there was a defect in the Goods at the time of purchase, or we have agreed in correspondence that you may return them.
2. Before you return the Goods to us, please carefully re-read the instructions and check that you have assembled it correctly.
3. The Goods must be returned to us as soon as any defect is discovered but not later than 15 days.
4. Goods should be returned to our address in Australia:
a. with both Goods and all packaging in their original re-sellable condition;
b. securely wrapped;
c. including our delivery slip; or manufacturer’s delivery slip
d. at your risk and cost. You must tell us by email message to: customerservice@kkduplum.bike that you that you would like to return Goods: –
a. specifying exactly what Goods and when purchased. Please include a copy of your receipt.
b. giving full details of the defect or other reason for return.
c. You are required to take 3 different photographs, each from a different angle, clearly showing the defect. Include these in the email to us. These will be examined and assessed by us. If at our sole discretion, we deem the defect is a manufacturing fault, we will then issue a returns note.

If you send Goods to us without a returns note, we may not be able to identify sufficient details to enable us to attend to your complaint. Detailed instructions for returning faulty Goods are on Our Website at www.kkduplum.bike . Please note in particular that we cannot deal with your complaint unless you return the entire Goods that you bought: that is to say, unused, with all components and parts and in the original packaging.

In returning faulty Goods please enclose with it a note clearly stating the fault and when it arises or arose.

Our products are covered by our manufacturer’s guarantee for a minimum of 12 months.

If delivery was made to Australian address, you are also protected by the Competition and Consumer Act 2010.

If we agree that the Goods are faulty, we will either:
1. refund the cost of the goods excluding return carriage charges;
2. repair or replace the Goods as we choose.

Disclaimers

The law differs from one country to another. This paragraph applies so far as the applicable law allows.

All the conditions, warranties or other terms implied by the law of any country other than the Commonwealth of Australia are excluded from this agreement to the extent permitted by law.

We or our Content suppliers may make improvements or changes to Our Website, the Content, or to any of the Goods, at any time and without advance notice.

You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any large website. We would be grateful if you bring to our immediate attention, any that you find.

We give no warranty and make no representation, express or implied, as to:
1. the quality of the Goods;
2. any implied warranty or condition as to merchantability or fitness of the Goods for a particular purpose;
3. the correspondence of the Goods with any description;
4. the adequacy or appropriateness of the Goods for your purpose;
5. the truth of any Content on Our Website;
6. non-infringement of any right.

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of Our Website or the purchase of Goods.

We are not liable for personal injury or death, and our liability under this contract is limited, to the maximum extent permitted by law, to the value of the Goods you have purchased.

The warranty is ‘return to base’ and not a free in home service. This means the customer is responsible for any inwards freight charge to return product. If returning the product, please package the product in the same way it was sent to you when purchased. We are not liable for shipping damage caused by incorrect packaging

Outside of warranty terms?

If your product is outside the one-year warranty period or if the fault is not covered by the manufacturer’s warranty, we will happily repair your product where possible for a reasonable charge. Please contact us at customerservice@kkduplum.bike

Exclusions

Any consequential loss or damage to any person or property directly or indirectly as a result of using product.

The warranty is only valid in the country of purchase. If you file a warranty claim outside of the country of purchase you will be charged fees by the local provider.

Please note that wheels, tyres, inner tubes and hand grips are not covered by warranty, except for out of box instances of failure.

Consumers in Australia please note: The benefits to the consumer under our warranty are in addition to the rights and remedies afforded by the Australian Consumer Law in relation to the goods or services to which our warranty applies. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

General care instructions

Tyres and wheels.
The wheels are removable in order to be more accessible for maintenance, and to allow easier storage. Rubber tyres can react with some surfaces (including, but not limited to, vinyl floor coverings, carpets, synthetic laminates, parquet and linoleum) and cause stains. Always stand the kkdu plum trailer on a flat, protective surface when indoors.

Timber parts.
When not in use, the kkdu plum should be stored in a dry area to prevent wood damage. We recommend treatment of all timber parts, on all surfaces, every 1 month. If your kkdu plum is used in the rain, we recommend you dry the wooden parts thoroughly thereafter. Once dry, treat the wooden parts at the intervals recommended above. This can be done with e.g. ‘Intergrain exterior ultraclear’ sold by Bunnings Warehouse. If the swing arm locators on the underside of the timber base appear to be loosening, please contact us immediately for maintenance instructions.

Fasteners.
All fasteners on the kkdu plum trailer and rack should be regularly checked for loosening. Screws should be tightened if loose.

Front wheel.
If the front wheel appears to be loosening, please contact us immediately for maintenance instructions.

Adjustable Handle mechanism.
When adjusting the height of the handle, the lever on the side of the kkdu plum trailer should be loosened only to the point at which the interlocking teeth are able to be disengaged and rotated into the correct position. If the lever is rotated/loosened too far, there is a risk that the lever will come out. If so, screw the lever back in. Always tighten as securely as possible to prevent movement of the adjustable handle when in use.

Loading the trailer.

Care should be taken to secure the plastic tubs using the holes provided. When packing, make sure that items are distributed evenly to prevent tipping over. The centre of gravity of the trailer is at a point roughly 10cm in front of the rear wheel axle. If in doubt, always pack goods evenly in this location. Always use a suitable strap to secure items properly, whether the tubs are used or not. Ensure that long items do not protrude from the front of the trailer so as to interfere with cycling or walking.

Securing the trailer to your bike.

When securing the trailer, the correct position of the handle should allow the timber base to be parallel to a flat ground surface and to allow sufficient clearance of the front wheel away from the rear bicycle wheel. Ensure the handle is tightened securely. Lift the hitch lever and drop the hitch locator on the handle into the ‘U’ shaped hitch. Close the lever and lock it closed to prevent accidental opening. Always ensure that your bicycle is secure when hitching or un-hitching the kkdu plum trailer, to prevent it from falling over.

No brake.

Always hold the kkdu plum trailer securely when it isn’t attached to the bike, to prevent it rolling away.
